AGREEMENT

These Terms govern use of Fyzygy Take. By using Fyzygy Take, the user agrees to these Terms.

ELIGIBILITY

Fyzygy Take is for adults aged eighteen and over. A date of birth is collected at signup to confirm age, and anyone under eighteen cannot create an account. Use by anyone under eighteen is prohibited. A user must not impersonate another person or create an account for another person without their consent, and must provide accurate account information.

ACCOUNTS

Signup uses a one time passcode. Login uses a password. A forgotten password is reset through the first-time password-set path. A user is responsible for keeping their credentials secure and for activity under their account. A user has one Fyzygy account with a public handle, the same across the products, which the user can change at most once every thirty days; a retired handle is not reused. A user sets a display name for Fyzygy Take, and the display name and handle appear with the user's public posts and polls.

YOUR CONTENT

A user keeps ownership of the posts, polls, media and text they create. To provide the service, the user grants the company a non-exclusive, royalty-free, worldwide licence to host, store, reproduce and display that content for the purpose of operating and providing Fyzygy Take. This licence ends when the content is deleted from our systems, which a user can do by deleting the content or the account, subject to the retention the child safety standards and the law require. A user chooses whether a post or poll is public or Followers only. A public post or poll has its own page on the website that anyone can view without an account, and can be shared by its link, for which the company generates a preview image. A Followers-only post is seen by the author and the author's followers and cannot be shared. Deleting a post deletes its files, and a replaced profile or page picture deletes the old file. A user is responsible for the content they create, including holding the rights needed to post it, and is liable for content that infringes the rights of others.

CHECKING OF UPLOADS

Media a user uploads is checked for child sexual abuse material before it is published, as the child safety standards describe; a video is checked whole, in the same way as an image. Content that does not pass the check is not published.

PUBLIC POSTS, POLLS AND VOTING

A user may make a post or poll public or keep it Followers only. Public posts and polls have their own pages on the Fyzygy Take website, viewable without an account. A poll closes twenty-four hours after it is made. Anyone may vote on a public poll without signing in; each device may vote once, and the vote is counted without identifying the voter, as the Privacy Notice describes. Poll results are shown to a signed-in user. Public posts and polls are indexed by search engines, and a public profile or an approved page may appear by its name; a Followers-only post, a private profile, a page under review, and the content of a suspended or deleted account are not. Making a post private or deleting it removes it from Fyzygy Take at once, and search engines then drop it on their own schedule, which the company does not control. The company may remove a public post, poll or page that breaks these Terms or the law.

YOUR FEED

A user's feed shows posts from the people and pages the user follows first, with the newest on top, and then other public posts. The order is not based on a profile of the user beyond who they follow.

PAGES

A user may create a page for a cause, a community or an organisation, with a picture, in the app or on the website. Pages are free. A page that promotes a film, a brand, a product or a business is not accepted. Every new page is reviewed by the company before it becomes public. A user may report a page. The company may remove or refuse a page that breaks these Terms, these page rules, or the law.

CONTENT MODERATION AND REMOVAL

The company may remove content or restrict access to it where it believes the content breaks these Terms or its policies, or where the law permits or requires. Where content is child sexual abuse or exploitation material, it is removed from view immediately and preserved as evidence for legal process, as the child safety standards describe.

INTELLECTUAL PROPERTY, COMPANY PROPERTY

The company's own materials, namely its trademarks, its user interface, its software, and its designs, are the company's property or licensed to it, and may not be copied or commercially used without permission. This clause covers the company's assets. It does not claim ownership of user content, which is addressed above.

SUSPENSION AND TERMINATION

The company may suspend or close an account that breaks these Terms or the law, or where the law requires, including for repeated infringement of the rights of others. A suspension applies to Fyzygy Take only: the person cannot sign in to Fyzygy Take or post, comment, like, follow or vote, and their posts and profile are hidden, but nothing is deleted, and Fyzygy Shelf, Fyzygy Conductor and the account centre keep working. The person is sent a notice stating the reason category, and may appeal. The company emails the user, at a verified email address only, when an account is suspended, when a suspension is lifted, and when an appeal is decided. A user may close their account at any time, which begins the account closure and deletion process described in the privacy notice and the account and data deletion page.

PRIVACY

The company handles personal data as described in the Privacy Notice. A user must agree to that notice to use Fyzygy Take.

ADVERTISING

Fyzygy Take shows advertising, governed by the advertising page for users.

UPDATES TO THE APP

The company updates Fyzygy Take through Google Play. In addition, when the app opens it may download an update to its own code and use that update at the next launch.

DISCLAIMERS

Fyzygy Take is provided as it is. The company does not guarantee that it will always be available or error free.

LIABILITY

The company is not liable for indirect or consequential loss, or for loss arising from content posted by other users.

INDEMNITY

A user agrees to indemnify and hold the company harmless from claims, liabilities, damages, losses or expenses arising from the user's breach of these Terms or of the law.

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India, and the courts at Bengaluru, Karnataka have exclusive jurisdiction, for every user, consumers included.

CHANGES

The company may update these Terms and will make material changes visible before they take effect. Continued use after changes take effect means the user accepts them.
